Terms & Conditions

These terms and conditions apply to the use of www.analogueoutlaw.com and the placing of any order.  If you do not agree to these terms and conditions you must not use this website or place an order.

Important information

  1. The characteristics and prices of the goods (inclusive of VAT) to be supplied to you are as described on the website www.analogueoutlaw.com.  The general characteristic of the goods is that they are gifts.    

  2. The identity of the trader is Hollie Boughton trading as Analogue Outlaw.

  3. The timescale for performance of the contract is determined by the postage option you select.  Delivery arrangements, costs and timescales are shown on www.analogueoutlaw.com.  You can select the speed of service you require.

  4. The trader is legally obliged to supply goods that are in conformity with the contract.  Under the Consumer Rights Act 2015, goods are required to be of satisfactory quality, as described and fit for purpose.

  5. The trader is not VAT registered.

  6. Payment methods accepted by the trader are shown on the checkout page of www.analogueoutlaw.com.  An order is not placed until you have completed checkout and paid in full for the goods. 

  7. In order to place an order you must add the items you wish to purchase to your basket and then complete checkout, making full payment for the goods.  

  8. In the event the trader is unable to accept your order (for example, the goods are out of stock, your payment is not completed, there is a pricing error or description error, or you do not meet minimum age requirements to purchase goods), the trader will reimburse you the cost of the goods and any postage costs you have paid within 14 days of your order; no further compensation will be payable to you for the trader’s inability to supply the goods.  

  9. If the trader is only able to partially accept your order the trader will email you to confirm whether you wish to proceed with your order; in the event that you do not, you will be fully reimbursed for all costs you have paid.

  10. By placing an order, you make an offer to form a contract with the trader.  The trader will confirm the contract with you as soon as possible and provide confirmation by email; the contract is formed when the trader despatches the goods to you.

  12. The trader is registered with Hastings Borough Council as a food business operator.

  13. All personal information you supply to us (such as your name, address, email address, telephone number) must be true and accurate; you must not use a false name or any other person’s identity when placing an order with us.

  14. The law applicable to any dispute arising out of your use of www.analogueoutlaw.com, the placing of any order, or any contract made with the trader, is governed by the laws of England.  By using www.analogueoutlaw.com and/or placing an order with the trader and/or forming a contract with the trader, you submit to the exclusive jurisdiction of the courts of England and agree that only the courts of England have jurisdiction to determine any dispute arising out of these terms and conditions, the use of www.analogueoutlaw.com, the placing of any order, or the formation, terms and effect of any contract with the trader, or any other dispute with the trader.

The Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013: Cancellation Rights

Under this legislation, you have the right to cancel your contract when you purchase from us online, provided that you exercise your right within 14 days after the day on which you (or a person identified by you to take possession of the goods) receive the goods.  Please note, this right does not apply to:

  1. goods made to your specifications, or which are clearly personalised;

  2. goods which are liable to deteriorate or expire rapidly, such as food;

  3. products which were delivered to you sealed (such as body care), when you have broken the seal.

Your statutory rights if goods are not as described or are faulty are not affected by this.

 

If you want to exercise your right of cancellation:

  1. You must make a clear statement to the trader setting out your decision to cancel the contract (you can use the model cancellation form in part B of Schedule 3 of the Regulations, set out below).  Your notification must include your full name, postal address, email address, telephone number (where available) and order number.  You can contact the trader by email at speak@analogueoutlaw.com or by post to 3 Oliver Close, Hastings TN34 1RA. Alternatively, use our Returns Form.

  2. You must take reasonable care of the goods and return them to the trader at your cost within 14 days of cancellation; the trader will not reimburse any costs you incur in returning the goods and it is your obligation to pay for the costs of returning the goods. 

  3. You must not break the seal on any goods which are in sealed packaging; if you do, you will not be able to return the goods for a refund unless they are faulty or not as described.

  4. Provided the goods are returned to the trader in the condition they were supplied in, the trader will reimburse you to the method you used to pay for the goods in the amount you paid.  The trader will reimburse you any payment you made for delivery of the goods to you, unless you expressly chose a kind of delivery costing more than the least expensive common and generally acceptable method offered by the trader; in that case the trader will reimburse you in a sum up to the amount you would have paid if you had chosen the least expensive common and generally acceptable kind of delivery offered by the trader.  

  5. Reimbursements will be made no later than 14 days after the trader receives the goods back from you.  If the value of the goods is diminished by any amount as a result of your handling of the goods, beyond what is necessary to establish the nature, characteristics and functioning of the goods, the trader will deduct that amount from your reimbursement, up to the contract price.
